It happens. I’ve seen agencies use questionable science during NEPA processes. The system is not perfect. Usually, though, relief is sought through administrative appeals (often hopeless) and ultimately, the courts. The illegal occupation of the refuge is a manifestation of something much deeper and darker than just a quibble with NEPA. In my opinion, attributing it to that trivializes what’s going on there.
